Welcome to Veinoptician. This website (the "Site") is owned and operated by Veinoptician ("we", "us", "our"). By accessing or purchasing from this Site, you ("the Customer", "you") agree to be bound by the following Terms and Conditions. Please read them carefully before placing an order.
1. CONTRACT FORMATION & RIGHT TO DECLINE ORDERS
- 1.1 Invitation to Treat: The display of products on our Site constitutes an "invitation to treat" and not a legally binding offer.
- 1.2 Order Acceptance: A legally binding contract is ONLY formed when we dispatch the goods and send you a "Shipping Confirmation Email." The automated "Order Receipt Confirmation Email" does not constitute acceptance of your order.
- 1.3 Right of Refusal: We reserve the right to refuse, cancel, or limit any order at our sole discretion at any time prior to dispatch (e.g., due to pricing errors, inventory stockouts, suspected fraud, or inaccurate prescription data). If your payment has already been processed, a full refund will be issued immediately, and we shall have no further liability to you.
2.1 Legal Capacity & Age: By placing an order for prescription lenses, you warrant that you are at least 18 years of age and are not legally blind or purchasing on behalf of a minor (under 16), in compliance with UK and EU optometry regulations.
2.2 Prescription Validity: You warrant that the prescription provided is accurate, clear, and provided by a registered optometrist or medical practitioner within the last 24 months. We accept no responsibility for visual discomfort, headaches, or physical injury resulting from inaccurate, outdated, or incorrectly entered prescription data (including Pupillary Distance - PD).
2.3 PD Measurements: If you do not provide a specific Pupillary Distance (PD), you agree that we may use an industry-standard average PD. You waive any right to claim defects or errors based on standard PD replication unless physical manufacturing error can be proven.
(So please make sure to accurately fill in your eyeglass prescription data, and we will also send you emails to repeatedly confirm your lens prescription data.)
3. CUSTOM PRODUCTS EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
3.1 Standard Goods: For non-customized products (e.g., ready-to-wear sunglasses, standalone empty frames), customers in the UK and EU have a statutory right to cancel and return the order within 14 days of delivery (extended to 15 days under our store policy).
3.2 Custom/Prescription Exclusions: In strict accordance with Article 16(c) of the EU Consumer Rights Directive (2011/83/EU) and Regulation 28(1)(b) of the UK Consumer Contracts Regulations 2013, the statutory 14-day right of withdrawal (cooling-off period) DOES NOT APPLY to goods made to the consumer’s specifications or clearly personalized.
3.3 Finality of Custom Orders: All prescription lenses and custom optical modifications are non-refundable and non-exchangeable for non-quality issues (such as change of mind, improper styling choices, or incorrect prescription input). Any gesture of goodwill (e.g., €20 voucher) offered under our Return Policy is entirely at our discretion and does not waive this legal exclusion.

4. PRICING, TYPOGRAPHICAL ERRORS & CURRENCY
- 4.1 Pricing Errors: While we strive for accuracy, typographical or pricing errors may occur. In accordance with English and European contract law (doctrine of unilateral mistake), if a product is listed at an incorrect price, we are under no obligation to provide the product to you at the incorrect (lower) price, even after an order confirmation has been sent, provided the error was pricing manifest.
- 4.2 Currency & Taxes: Prices are displayed in Euros (€) or British Pounds (£). For UK and EU cross-border shipments, prices at checkout include VAT under DDP/IOSS frameworks. However, you are liable for any regional handling variances if you input an invalid shipping country.Or we have the right to refuse shipment, and at the same time we will immediately refund your order payment.
5. LIMITATION OF LIABILITY
- 5.1 Scope of Liability: To the maximum extent permitted by applicable UK and EU laws, Veinoptician shall not be liable for any indirect, incidental, punitive, or consequential damages (including but not limited to loss of income, medical bills, or eye strain) arising out of the use of or inability to use our products.
- 5.2 Maximum Indemnity: Our total liability to you for any claim arising out of a purchase contract shall be strictly limited to the actual net purchase price paid by you for the specific product giving rise to the liability.
- 5.3 Variations in Product Display: We make every effort to display product colors and textures accurately. However, due to monitor variances, slight color or textural discrepancies between the online image and the physical product do not constitute a "product defect" or "misdescription."
Based on this, if there are products on the product detail page without actual photos, you can contact our customer service, and we will provide you with unfiltered, non-batch real photos and detailed images of the products.
6. INTELLECTUAL PROPERTY & FAIR USE
- 6.1 All content on this Site, including but not limited to imagery, text, graphics, logos, lens technologies descriptions, and design, is the exclusive intellectual property of Veinoptician. Any unauthorized reproduction, scraping, or commercial exploitation is strictly prohibited and will result in immediate legal action.
- 6.2 If you believe that our images, articles, or products infringe on your rights, you can contact us and provide relevant evidence at service@veinoptician.com. We will respond to you and take action accordingly.
7. GOVERNING LAW AND JURISDICTION
7.1 UK Customers: For residents of the United Kingdom, these Terms shall be governed by and construed in accordance with the laws of England and Wales, and subject to the non-exclusive jurisdiction of the courts of London.
7.2 EU Customers: For residents of the European Union, these Terms shall be governed by the laws of [Insert country where your company registration is based, e.g., Germany / Ireland], without prejudice to any mandatory consumer protection rights you possess under the laws of your local residence state.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
